On this week’s Solari Report, we will addressing the most important question facing U.S. citizens during this year and for years to come. Under the U.S. Constitution, who has the ultimate authority to determine the legality of an enforcement action and enforce the law in your community?

If the Congress legislates and the President signs bills or executive orders that are unconstitutional, who has the power to stop an attempt to enforce in your state or county? Is it your Governor, State Attorney General or is it your local Sheriff?

Do you know your local Sheriff? With elections coming up this November, do you know who is running for Sheriff?

We will be speaking with Richard Mack, former Sheriff of Graham County, Arizona, from 1988-1997. During his tenure, federal officers informed the sheriffs of the state that they would be required to enforce the so-called “Brady Bill.” In 1994, Mack and six other sheriffs from across the country, challenged the constitutionality of the Brady Bill. They took the case all the way to the Supreme Court, where they won in a landmark 5-4 split decision based on the 10th Amendment to the U.S. Constitution. In delivering the opinion of the Court, Justice Scalia wrote:

“The Federal Government may neither issue directives requiring the States to address particular problems, nor command the States’ officers, or those of their political subdivisions, to administer or enforce a federal regulatory program.”

I will ask Richard to address your questions about how to learn about and support your local Sheriff. We will  discuss the growing 10th Amendment movement, the impact of federal health care legislation, and efforts to encourage Sheriff’s and other enforcement authorities to remain loyal to their oath of office, such as Oathkeepers and the recent resolution of the Southern National Congress. Then, of course, there are efforts by the federal government to keep the Governors in line.
